In October 2006 the Parliament of Victoria passed the Conveyancers Act 2006. When the act came into operation it established a new system of regulation and licensing for non-lawyer Conveyancers in Victoria. Under the Act, a person will not be permitted to carry on a conveyancing business in Victoria without a conveyancer’s licence from the Business Licensing Authority or unless the person is an Australian Legal Practitioner for the purposes of Victoria’s Legal Profession Act 2004
To be eligible for a licence, a Conveyancer must have obtained 12months work experience and have completed educational qualifications that will be set out in regulations, and we advise all applicants
should contact BLA or Consumer Affairs Victoria 121 Exhibition ST Melb 3000, regarding any, and all, licensing questions.
Once the act comes into operation, non-lawyer conveyancers will only be permitted to carry on a conveyancing business in Victoria if they have a conveyancers licence from the Business Licensing Authority.
Professional obligations similar to those in place for legal practitioners will apply to licensed conveyancers. These include obligations to disclose costs and conflicts of interest to clients.
They will also include strict obligations relating to the maintenance and auditing of trust accounts, which will reduce the risk of fraud in relation to trust moneys
NBIA is registered for RPL and RCC and we are happy to help you with this process if you have any industry experience or previous qualifications.
Assessment will be comprised of use of either assignments, discussion (question and answer and role plays), on the job practical experience, workbook q+a and tests where a minimum 70% pass mark is required, CV (RPL), references (RPL), role play and/or simulation, research, projects, interview and case studies etc or a combination of the above dependant upon the applicants situation. All assessments are deemed to have occurred at our Ivanhoe premises.
Each unit workbook has formative and summative questions and assignments, all must be completed satisfactorily and submitted as one unit (and in word.doc if submitted electronically)for the candidate to be assessed as competent.
